Nova Education Germany GmbH (“we,” “our,” or “us”) is committed to providing transparent terms for your right of withdrawal. This policy is structured in compliance with the German Civil Code (BGB) and the EU Consumer Rights Directive while considering exceptions applicable to educational programs, services, and events.

1. General Right of Withdrawal

1.1. Standard Withdrawal Period:
You have the right to withdraw from this contract within 14 days without giving any reason, unless otherwise specified in the exceptions below.

1.2. How to Exercise Your Right:
To exercise your right of withdrawal, you must inform us via email at [email protected]. Your withdrawal request should include:

  • Your full name.
  • Details of the purchased service or product.
  • The date of purchase.

1.3. Processing Timeline:
Once we receive your request, you will be notified of the withdrawal status within 7 business days.

2. Exceptions to the Right of Withdrawal

Certain services and products are exempt from the right of withdrawal under the German Civil Code (§ 356 BGB) and the EU Consumer Rights Directive Article 16:

2.1. Educational Services and Program Enrollment

  • Withdrawal is permitted up to 7 days before the program start date. After this period:
    • If the program has started, no withdrawal or refund will be granted.
    • If partial services have been used, refunds will be limited to unused portions, minus an administrative fee.

2.2. Scheduled Events

  • For scheduled events such as seminars, trips, or workshops, withdrawal is only possible 14 days before the event date. After this period, refunds are not available unless the event is canceled by Nova Education.

2.3. Digital Content and Materials

  • The right of withdrawal does not apply once:
    • The digital content (e.g., e-books, online courses) has been accessed or downloaded.
    • The user has explicitly consented to immediate access and waived their right of withdrawal.

2.4. Customized or Personalized Services

  • Services that have been personalized or tailored to your specific needs are excluded from the right of withdrawal.

3. How to Withdraw Your Consent or Request Refunds

To withdraw from a service or request a refund:

  1. Email Support:
    Send your request to [email protected] with the subject line “Withdrawal Request” or “Refund Request.”
  2. Details to Include:
    • Full name and contact information.
    • Order ID or service details.
    • Reason for withdrawal (if applicable).
  3. Response Time:
    • Your request will be reviewed, and a response will be provided within 7 business days.

4. Refund Eligibility After Withdrawal

4.1. Programs and Services:

  • If the program is canceled by Nova Education, you will receive a full refund.
  • Withdrawal requests submitted after the specified period or after program commencement are not eligible for refunds.

4.2. Digital Products:
Refunds are not available for digital content once accessed or downloaded.

4.3. Scheduled Events:
Refunds for trips, workshops, or seminars are only available if the request is made within the specified withdrawal period.

5. Legal Compliance and Documentation

This withdrawal policy aligns with the following legal regulations:

  • German Civil Code (BGB): § 355 (Consumer Withdrawal Rights), § 356 (Digital Products and Services).
  • EU Consumer Rights Directive Article 16: Exceptions to withdrawal rights.
